1. Agreement to Terms

By accessing or using Shortful AI ("the Service"), operated by Shortful AI ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your account credentials
  • Promptly update your account information as needed
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

4. Subscription and Payments

Shortful AI offers subscription-based plans. By subscribing, you agree to the following:

  • Billing: You will be billed in advance on a recurring basis (monthly or yearly) based on the plan you select. Payment is processed through Stripe.
  • Credits: Each plan includes a set number of video and image generation credits per billing cycle. Unused credits do not roll over to the next billing period.
  • Upgrades/Downgrades: You may change your subscription plan at any time. Changes will take effect at the start of the next billing cycle.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
  • Price Changes: We reserve the right to adjust pricing. You will be notified of any price changes in advance.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use the Service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Generate deepfake content intended to deceive, defraud, or harm individuals
  • Impersonate any person or entity without their explicit consent
  • Create content that infringes upon the intellectual property rights of others
  • Use the Service to distribute spam, malware, or engage in phishing
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Circumvent any usage limits, access controls, or security measures

We reserve the right to remove content and suspend or terminate accounts that violate these terms at our sole discretion.

6. Intellectual Property

Our Property: The Service, including its design, interface, software, algorithms, and AI models, is owned by Shortful AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

Your Content: You retain ownership of the content you create using the Service (videos, images, scripts), subject to the following conditions:

  • You are responsible for ensuring that your content does not infringe on any third-party rights
  • You grant us a limited, non-exclusive license to store, process, and display your content as necessary to provide the Service
  • AI-generated content is provided "as-is" and may be subject to limitations under applicable intellectual property laws

7. AI-Generated Content

Content generated through our Service uses artificial intelligence and may not always be perfect. You acknowledge that:

  • AI-generated outputs may contain inaccuracies or imperfections
  • You are solely responsible for reviewing and approving all generated content before use
  • We do not guarantee that AI-generated content will be free from errors or suitable for any particular purpose
  • You are responsible for compliance with applicable laws regarding the use of AI-generated content in advertising, marketing, and media

8. Limitation of Liability

To the fullest extent permitted by law, Shortful AI and its directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Any damages arising from your use of AI-generated content
  • Service interruptions, delays, or errors

Our total liability to you shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Indemnification

You agree to indemnify and hold harmless Shortful AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of third parties.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and associated data after a reasonable retention period
  • Provisions regarding intellectual property, limitation of liability, and indemnification shall survive termination

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shortful AI regarding your use of the Service, superseding any prior agreements.
